Gwinnett County grand jury indicts former Lilburn officer
GWINNETT COUNTY, Ga. - A Gwinnett County jury has indicted a former Lilburn police officer accused of inappropriately touching and videotaping a woman while on duty.
Investigators said Gary Livingston, 34, and another officer responded to an alarm call at an apartment complex last May. Once they learned it was a false alarm, the officers left the location. Minutes later, police said Livingston returned and asked the 31-year-old property manager to participate in what he called a college psychology course project.
According to detectives, the former officer then asked the woman to pretend she was asleep and touched her while recording it with his personal cell phone.
The woman told police she would have not consented, but the officer was in uniform and she was in fear.
Livingston was indicted on two counts of unlawful surveillance, one count of simple battery and one count of violation of oath of office.
Livingston worked as an officer with Lilburn Police from 2013 until his termination last June.
