The Smyrna police lieutenant who shot and killed Nicholas Thomas last year will not face federal charges.

The U.S. Attorney’s Office confirmed it will not pursue charges against Lt. Kenneth Owens.

Ownes shot and killed Thomas while attempting to arrest him on probation violation, according to investigators.

Surveillance video of the incident shows Thomas trying to run down officers with a car before shots were fired.
