Police told FOX 5 News an off-duty Fulton County Deputy shot a male in the early morning hours on Friday in the parking lot of the Ivory Restaurant on Whitehall Street.

The Fulton County deputy was at the restaurant working his second job.

According to the GBI, some sort of altercation started inside the restaurant and the off-duty deputies used a stun gun on the man. He was then allowed to leave the restaurant, but went to his car outside and pulled out an assault rifle.

He did not fire the weapon, but that's when one of the deputies opened fire.

Emergency officials said the 46-year-old man was shot in the neck and was taken to Grady Memorial Hospital. His name has not been released.

The deputy was not hurt in the shooting.

The GBI is investigating the incident.
