Attorney defends DeKalb Fire employees despite police body cam

Attorney Musa Ghanayem is fighting back on behalf of two DeKalb Fire department employees who claimed last May that a Stone Mountain police officer cussed one of them out during a traffic stop.

FOX 5 I-Team obtained the officer's body camera that showed no cussing.

“In fact,” says Musa Ghanayem, “in the spit of complaint, its 100% accurate.”

This is how it all unfolded. Last May, Sergeant Steven Floyd pulled over DeKalb Fire Captain Terrell Davis for an expired tag at a local school.

Davis called his co-worker Krystal Cathcart to the scene.

Sgt. Floyd issued the ticket but had to ask Krystal Cathcart to step away from the scene, since she wasn't involved.

Krystal Cathcart filed a written complaint, which included a warning about making a false sworn statement. She claimed Sgt. Floyd created "a sense of fear" at the scene, cussed her out twice, telling her to "back the f*** up" or he will throw her in the "back of my squad car."

DeKalb Fire Captain Terrell Davis backed up her written complaint saying Sgt. Floyd was "unprofessional, belligerent and disrespectful."

But, when the FOX 5 I-Team obtained Sgt. Floyd’s body camera it showed he never cussed anyone.

In fact, Ms. Cathcart recanted the allegation of cussing after Stone Mountain internal affairs showed her the body camera video.

Musa Ghanayem, told us: “She fully admitted that, if she misremembered the circumstances with regard to cursing, that is something she owns. But, with regard to the spirit of the complaint, I don't' think she's done anything wrong.”

Ms. Cathcart has resigned and taken another job. Ghanayem says he hopes Captain Davis, a 19 year veteran with a stellar record at the Fire Department won’t be punished.
