Cousin charged in NW Atlanta teen's shooting death

Police have charged a family member in connection with the shooting death of 15-year-old Marquez Montgomery.

Atlanta police say his cousin, Dontavious Montgomery, is charged with felony murder.

On Monday, police said Dontavious fatally shot the teen in the head inside a home on Adkins Road. The shooting was reportedly unprovoked.

Marquez's family told FOX 5 he was a defensive football player for Mays High School, and played the Tucker High School Tigers just this past Friday.

In a surprising development, Dontavious was out on bond for a previous offense, police said. In January of 2015 he was arrested and charged with murder and aggravated assault in the stabbing death of Nicole Roberts. For that crime, he was granted $100,000 bond with conditions and was released on October 13, 2015.

Marquez and Dontavis'  uncle said the deadly shooting was an accident.
"It was an accident. People gone try to twist it and make him seem like a bad kid, but he was a good kid as well.

He was a favorite cousin and he's dealing with it now," D.T. Montgomery said at the family's Northwest Atlanta home.

Dontavis Montgomery is being held at the Fulton County Jail. A hearing is scheduled for 11 a.m. Wednesday.
