Man sues Georgia DOT to slow I-85 construction

A man living close to where the Interstate 85 bridge collapsed has filed a lawsuit in Fulton County Superior Court to slow down construction of the overpass. 

In court documents, the suit names the Georgia Department of Transportation, and asks a judge for an injunction against the DOT to ban round-the-clock construction in efforts to reach the completion date of June 15.

The plaintiff, named Tyler Gaston, explains he lives at the adjacent apartment named The Optimist, which faces the site of the bridge collapse. Gaston claims the construction has caused "incredible noise," making it "impossible to sleep," and causing "acute sleep deprivation" that puts him "at risk for heart disease... heart attack... heart failure." 

The plaintiff, in documents, asks the judge to order the DOT to schedule its construction timeline along hours designated by noise ordinances in the city of Atlanta, and end construction on weekdays during 10 p.m. to 7 a.m., and further limit weekend and holiday operations. 

Gaston would not respond to FOX 5's requests for comment. He's scheduled to appear in court on April 18.
