Family files lawsuit against Waffle House over shooting

The family of a man killed inside a Waffle House almost two years ago has now sued the Georgia based restaurant chain.  

Adrian Mosely's family wants changes following his death. The father of five children was shot and killed by a Waffle House employee following an argument.

Gladys Mosely hopes after two years, she can finally get some justice for her son and his children. She admits her son got into a verbal argument with a restaurant employee, but said there was no justification in why that employee pulled out a gun and shot him four times, killing him.

It was all caught on video. It happened around 4:30 a.m. at the Fulton Industrial Boulevard location.

The family’s attorney said Adrian Mosely threw water on the cook after he was refused service. The video shows the cook standing on the other side of the counter. That is when family members said the cook reached below the counter, pulled out a gun and opened fire.        

Fulton County police originally charged the cook in the shooting, but prosecutors later dropped the charges.

FOX 5 has reached out to Waffle House headquarters for a statement, but has not received one. FOX 5 has also left messages with the Fulton County District Attorney’s Office, but has not heard back from them.
