ATLANTA (FOX 5 Atlanta) - A North Georgia State Representative has taken his fight to stay in office to the State Supreme Court.
Earlier this month, a judge in Banks County ordered a third election in the hotly contested House District 28 race.
Chris Erwin, who won a special primary election by two votes had served in the state legislature this session.
He was removed from office after a judge found four illegal votes in the race.
Erwin has now appealed that decision to the high court.
Erwin's opponent, Dan Gasaway has successfully contested the election results in this race twice.
A third primary election is scheduled for April 9.
